Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and DehSuh. They explain how DehSuh works, the rules for using our platform, and the rights and responsibilities of everyone who visits, creates an account, lists on the platform, submits an inquiry or application, makes or receives reservations, pays a deposit, or otherwise uses our services.

The short version

DehSuh is a marketplace platform where people advertise vehicles, equipment, and spaces, and where interested people connect with the lister directly. Listers pay for subscriptions and other marketplace services; for listings that support it, customers can pay a deposit and an associated service fee through DehSuh to reserve availability. The final rental, sale, or service arrangement is always between the customer and the lister — DehSuh is not a party to it. Use DehSuh honestly, lawfully, and respectfully.

1 Accepting these terms

By accessing or using DehSuh's website, mobile experience, or related services (together, the "Service") — whether or not you create an account — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.

You must be capable of forming a legally binding contract to use the Service. If you are using the Service on behalf of a business, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

2 Our role as a marketplace

DehSuh operates a marketplace that connects people advertising vehicles, equipment, and spaces with people looking to find them. We provide the platform, tools, and — where enabled — reservation and payment infrastructure that facilitate that connection. We are not the owner, renter, seller, buyer, operator, agent, insurer, or otherwise a party to any agreement formed between users as a result of a listing, inquiry, or reservation.

  • We do not own, inspect, endorse, warrant, or take possession of any listed vehicle, item, or space.
  • We do not set, collect, or take any share of the underlying rental, sale, or service price — that price is agreed and settled directly between the customer and the lister, outside the Service, except to the extent a deposit is processed through DehSuh as described in Section 6.
  • Listers are solely responsible for their listings, pricing, availability, conduct, and for honouring any commitment or reservation made through the platform.
  • When you contact, respond to, or transact with another user, you are dealing with that person directly and at your own discretion.

We do not guarantee the accuracy, completeness, legality, safety, or availability of any listing, or that any user is who they claim to be. Verification steps we perform (see Section 4) are undertaken to support marketplace trust and safety — they are not a guarantee or endorsement of any listing or user, and they do not make DehSuh a party to any transaction between users.

3 Eligibility & Your Account

You must be at least eighteen (18) years old to use DehSuh, create an account, publish listings, submit inquiries or applications, make reservations, pay deposits, or use any other features available through the platform. By using DehSuh, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

  • You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
  • You must keep your account information accurate and up to date, including your name, email address, telephone number, and any other information required to use the platform.
  • You may not impersonate another person or business, create an account using false or misleading information, or create an account on behalf of another individual or organisation without proper authority.
  • You must notify DehSuh immediately if you believe your account has been accessed without your permission or if you suspect any unauthorised use of your account.
  • Where required for certain features, listings, reservations, payments, or lease applications, DehSuh may request additional information or documentation to help confirm your identity or eligibility. Providing such information does not guarantee approval, verification, or continued access to the platform.
  • You are responsible for ensuring that your use of DehSuh complies with all applicable laws, regulations, licensing requirements, and contractual obligations in your jurisdiction.

You may stop using DehSuh or request the closure of your account at any time. DehSuh may refuse, suspend, restrict, or terminate accounts in accordance with Section 13 of these Terms where necessary to protect the platform, comply with legal obligations, investigate suspected misconduct, or enforce these Terms.

4 Becoming a lister & verification

Anyone may create a free account as a regular user. To publish listings on DehSuh, a user may apply to become a lister. Because trust and safety are important to our marketplace, becoming a lister may require submitting verification information and supporting documents.

Depending on the type of listing or account, verification information may include government-issued identification, business information, business registration documents, tax information, ownership documents, permits, licences, or other supporting information requested by DehSuh.

DehSuh may approve, decline, restrict, or remove lister access at its discretion. We may use third-party verification providers to assist with identity, business, payment, or document verification. By applying to become a lister, you authorise DehSuh to collect, process, store, and verify submitted information for marketplace trust, safety, compliance, and fraud-prevention purposes.

Verification helps improve marketplace trust but does not guarantee the quality, legality, ownership, condition, availability, or performance of any listing or user. Verification does not make DehSuh a party to any agreement between users.

5 Subscriptions, listings, slots & marketplace fees

DehSuh may offer subscription plans that allow listers to publish and manage listings on the platform. Each plan may include a defined number of listing slots, features, visibility benefits, analytics, promotional tools, or other marketplace services.

A listing slot represents the number of active listings a lister may maintain based on their selected plan. Removing a listing may free an available slot for reuse, subject to the applicable subscription limits.

If a subscription expires, is cancelled, or payment is unsuccessful, DehSuh may limit, pause, hide, or remove listings that exceed the active plan allowance until the lister renews, upgrades, or adjusts their account.

  • All applicable prices and fees are displayed before confirmation of purchase.
  • Subscription payments and other marketplace payments may be processed through third-party payment providers.
  • DehSuh does not store complete payment card or banking credentials.
  • Recurring subscriptions continue until cancelled. Cancellation prevents future renewals but does not automatically refund previously paid periods.
  • Subscription fees are generally non-refundable except where required by law or where DehSuh determines a refund is appropriate.
  • DehSuh may modify subscription plans, features, listing limits, pricing, or marketplace services with reasonable notice where required.

In addition to subscriptions, DehSuh may charge marketplace-related fees, including but not limited to reservation fees, service fees, transaction fees, verification fees, promotional fees, featured listing fees, or other platform charges. Any applicable fees will be disclosed before payment.

6 Deposits, reservations, payments & refunds

Certain listings may allow customers to submit a deposit through DehSuh to reserve availability or demonstrate commitment before completing arrangements directly with the lister.

6.1 Nature of deposits

  • Deposit amounts may be configured by listers using available deposit settings, including fixed amounts, percentages, minimums, or maximum limits.
  • Deposits are intended as an advance payment toward the customer's arrangement with the lister and do not represent the full rental, purchase, or service price unless explicitly stated.
  • A separate DehSuh marketplace service fee may apply for providing reservation, payment processing, and platform infrastructure.
  • Deposit payments may temporarily reserve dates or availability on a listing calendar to reduce double-booking.
  • Paying a deposit does not automatically create a rental agreement between DehSuh and the customer. The final terms of the transaction remain between the customer and lister.

6.2 Payment processing

Deposit and marketplace fee payments may be processed through third-party payment providers. DehSuh may verify payment status before confirming a reservation, including confirming that payment was successfully authorised and captured.

6.3 Refunds

  • DehSuh marketplace service fees are generally non-refundable after a reservation or payment service has been successfully provided, except where required by law or where DehSuh determines an error occurred.
  • Deposit refunds are generally determined by the applicable listing terms and the agreement between the customer and lister.
  • DehSuh may assist with refunds where appropriate, including cases involving technical errors, fraudulent activity, prohibited listings, or platform violations.

6.4 Lister payouts

DehSuh may delay, hold, or manage release of deposit-related funds where necessary for fraud prevention, payment verification, dispute handling, or marketplace protection. Applicable payout timing may vary depending on the listing category, payment provider, and account status.

7 Chargebacks & payment disputes

A chargeback is a request to reverse a payment made directly with a payment provider or card issuer, rather than a refund request made to DehSuh. Because a chargeback can reverse funds after DehSuh has already verified a payment, held or released funds, blocked availability on a lister's behalf, or paid out a lister, it carries real costs for the marketplace and for other users.

  • Contact us first. If you believe a deposit, service fee, or subscription charge was made in error, was unauthorised, or should be refunded, contact us using the details in Section 19 before initiating a chargeback. We review reports promptly and will issue a refund directly where one is due — this is typically faster than a chargeback and avoids unnecessary restrictions on your account.
  • Evidence we may submit. Where a chargeback or payment dispute is filed, DehSuh is entitled to provide the relevant payment provider with information reasonably related to the transaction — including reservation and account details, records of our payment verification, and related correspondence — to establish whether the charge was authorised and the marketplace service was provided as described.
  • Consequences of unwarranted chargebacks. Where a chargeback is determined to be unwarranted — for example, the charge was authorised and the corresponding service was provided as agreed — DehSuh may recover the disputed amount and any related processing costs from you, and may suspend, restrict, or terminate your account and your ability to make future payments through the Service, to the extent permitted by law.
  • Abuse of the dispute process. Initiating a chargeback for a legitimate, authorised charge you are simply dissatisfied with, rather than one that was unauthorised or made in error, may constitute misuse of the payment dispute process and a breach of these Terms, and DehSuh reserves all remedies available to it, including legal action, in serious or repeated cases.

Nothing in this section limits any right you may have under applicable law to dispute a charge with your payment provider — it describes how DehSuh responds to, and what DehSuh is entitled to do in connection with, such disputes.

8 Listing rules & standards

Listers are responsible for ensuring that all listings submitted to DehSuh are accurate, complete, lawful, and suitable for the marketplace.

  • Your listing information, pricing, availability, and descriptions must be accurate.
  • You must own, control, or have permission to advertise any item, vehicle, space, or service listed.
  • Your listings must comply with applicable laws, regulations, permits, licences, and ownership requirements.
  • You must have rights to all uploaded photos, descriptions, and materials.
  • You must honour confirmed reservations, deposits, and commitments made through the platform.
  • You must not publish fraudulent, stolen, unsafe, illegal, misleading, or prohibited listings.

DehSuh may review, rank, restrict, remove, suspend, or refuse listings where we believe necessary to protect users, maintain marketplace quality, comply with legal obligations, or prevent fraud.

9 Dealing with other users

When you contact a lister, respond to an inquiry, or communicate with another user through the Service, you are connecting with that person directly. Beyond the verification described in Section 4, we do not screen users, and we are not responsible for their conduct, the accuracy of their listings, or the outcome of any arrangement between you — including one preceded by a deposit or reservation made through the Service.

Exercise ordinary care and good judgement: verify details independently, agree your own terms directly with the other party, and take sensible precautions when arranging to meet, exchange items, or complete a transaction. Any rental, sale, or service agreement formed between users is solely between those users. DehSuh is not a party to that agreement and bears no responsibility for its performance, breach, or outcome, even where a deposit toward that agreement was processed through the Service.

10 Content & intellectual property

The DehSuh Service — including its software, technology, platform design, user interface, branding, trademarks, logos, databases, systems, and other platform materials — belongs to DehSuh or its licensors and is protected by applicable intellectual property laws.

DehSuh grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service only for its intended marketplace purposes. You may not copy, modify, distribute, reverse engineer, decompile, scrape, extract data from, create derivative works from, or use the Service to develop a competing platform without our written permission.

You retain ownership of content you submit to DehSuh, including listing descriptions, photographs, videos, reviews, and other materials. By submitting content, you grant DehSuh a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, adapt, and promote that content for operating, improving, marketing, and expanding the Service.

This licence allows DehSuh to display your listings, improve search and recommendation features, promote marketplace inventory, create advertisements, and provide platform functionality. You confirm that you have all necessary rights and permissions to submit the content and grant this licence.

DehSuh respects intellectual property rights. If you believe content available through the Service infringes your rights, contact us with sufficient information to identify the relevant work and allegedly infringing material, and we will review the matter.

11 Prohibited activities

When using DehSuh, you agree that you will not:

  • Violate any applicable law, regulation, or third-party rights, or submit false, misleading, fraudulent, defamatory, or inaccurate information.
  • Provide false identity, verification, ownership, business, listing, payment, or account information, or impersonate another person or organisation.
  • Harass, threaten, abuse, discriminate against, exploit, or harm another user, or misuse another user's personal information.
  • List or promote stolen, illegal, unsafe, counterfeit, prohibited, or unauthorised goods, services, vehicles, spaces, or experiences.
  • Upload content that infringes intellectual property, privacy, publicity, or other legal rights.
  • Scrape, crawl, harvest, copy, or systematically collect marketplace data, listings, pricing information, user information, or platform content for commercial purposes or to create a competing service.
  • Introduce malware, attempt unauthorised access, interfere with platform security, or disrupt the operation of DehSuh.
  • Circumvent security controls, usage limits, verification requirements, payment systems, or account restrictions.
  • Use fraudulent, stolen, or unauthorised payment methods, or abuse payment disputes, chargebacks, or refund processes.
  • Send spam, unsolicited promotions, or misuse DehSuh communication features.

Child safety. DehSuh has zero tolerance for content or behaviour involving sexual exploitation, abuse, or endangerment of minors. Any such activity may result in immediate removal, account termination, and reporting to appropriate authorities where required.

12 Third-party services & links

DehSuh uses third-party providers and services to operate certain platform features, including payment processing, mapping, verification, analytics, communication, and other marketplace functionality.

These services may include providers such as Google Maps Platform for location features and PayPal or other payment providers for payment processing. Your use of third-party services may also be subject to their own terms, privacy policies, and requirements.

DehSuh does not control and is not responsible for third-party websites, services, applications, content, availability, security, or practices.

13 Suspension & termination

You may stop using DehSuh or close your account at any time. DehSuh may suspend, restrict, remove listings, disable features, or terminate accounts where we believe it is necessary to protect users, maintain marketplace integrity, comply with legal obligations, prevent fraud, or enforce these Terms.

Reasons for action may include, but are not limited to, inaccurate listings, fraudulent activity, misuse of payments, prohibited content, abuse of other users, security concerns, or violations of these Terms.

Where an account is terminated due to violation of these Terms, subscription fees, promotional fees, or service fees already paid may not be refundable except where required by law.

Sections relating to intellectual property, content licences, payments, disputes, disclaimers, limitations of liability, indemnification, and governing law will continue after termination where applicable.

14 Disclaimers

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. DehSuh does not guarantee that the platform will always be uninterrupted, secure, error-free, or that all information provided by users will be accurate, complete, or current.

DehSuh operates as a marketplace platform connecting users. We are not the owner, renter, seller, buyer, operator, agent, insurer, or party to agreements formed between users.

DehSuh does not guarantee the condition, legality, ownership, availability, quality, safety, pricing, or performance of any listing, user, vehicle, item, space, service, or experience. Users are responsible for conducting appropriate checks and making informed decisions before completing transactions.

15 Limitation of liability

To the maximum extent permitted by law, DehSuh and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunities arising from use of the Service.

DehSuh is not responsible for disputes, losses, damages, injuries, fraud, cancellations, misrepresentations, agreements, transactions, or interactions between users.

Where liability cannot be excluded, DehSuh's total liability relating to the Service will not exceed the greater of the amount paid directly to DehSuh by you during the previous twelve months or US$100, excluding deposit amounts paid to or held for listers.

16 Indemnification

You agree to indemnify and protect DehSuh, its owners, officers, employees, contractors, and representatives against claims, damages, losses, liabilities, and reasonable expenses arising from your use of the Service, your listings, your content, your transactions with other users, your payment activity, your breach of these Terms, or violation of applicable laws.

17 Governing law & disputes

DehSuh operates from Jamaica and may be accessed internationally. These Terms and any disputes relating to the Service are governed by the laws of Jamaica, except where mandatory consumer protection laws provide additional rights that cannot be excluded.

Before starting formal proceedings, users should contact DehSuh first so we can attempt to resolve concerns informally. If a dispute cannot be resolved, applicable courts in Jamaica will have jurisdiction, subject to any mandatory rights available in the user's country of residence.

18 Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above, and for significant changes we'll provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms. If you don't agree to a change, please stop using the Service and, if you wish, close your account.
